"Genlista" refers to the AI listing-generation service operated by Bidleys VOF, handelend onder de naam Genlista (Chamber of Commerce 97400394). "User" refers to any person or business that creates an account or uses the Service. "Service" refers to the Genlista web application and any associated APIs, including AI-assisted generation of marketplace and auction listings.

To use the Service you must create an account with accurate information and be at least 18 years old. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

Genlista uses artificial intelligence to generate suggested titles, descriptions, bullet points and SEO keywords for marketplace and auction listings, based on photos and optional context provided by the user. Outputs are produced for platforms such as Catawiki, eBay, Etsy, Vinted, Marketplace and traditional auction houses.

AI-generated content is provided as a draft and starting point. The user is solely responsible for reviewing, correcting and verifying every output before publishing it on any third-party platform.

Genlista is offered as a paid subscription on a monthly basis. The current plans, prices, included generation quotas and features are shown on the pricing section of our website. All prices are in euros and exclude VAT where applicable.

Payments are processed by our payment provider (Stripe). By subscribing, you authorise recurring charges to your chosen payment method until you cancel. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period and you retain access until that date.

Unused generation quota does not roll over to the next period. We do not offer refunds for partial months or for unused generations, except where required by mandatory consumer law.

Consumers in the EU normally have a 14-day right of withdrawal under Art. 6:230o Dutch Civil Code. Because Genlista is a digital service that begins immediately upon subscribing, by starting to use the Service during the withdrawal period you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the Service has been fully performed (Art. 6:230p sub a Dutch Civil Code).

You retain ownership of any photos and input you upload. Listings generated by Genlista are licensed to you for unrestricted commercial use on the platforms you sell through. The Genlista platform, brand, source code, trained prompts and underlying technology remain the sole property of Bidleys VOF.

You agree not to:

• Use the Service for any unlawful purpose or to list counterfeit, stolen, restricted or prohibited goods.
• Upload content that infringes third-party intellectual property, privacy or portrait rights.
• Attempt to reverse-engineer, scrape, extract model weights from, or otherwise misuse the AI models.
• Resell, sublicense or expose the Service via your own API without a written agreement.
• Share account credentials with unauthorised users or circumvent generation quotas.

Genlista is an AI tool. All information generated by the Service — including titles, descriptions, attributions, dating, origin, condition assessments, period or value-related statements — is produced by automated systems on the basis of the photos and inputs you provide. AI models can and do make mistakes, hallucinate facts, misidentify objects and produce attributions that are factually incorrect. No rights can be derived from AI-generated information.

Bidleys VOF is explicitly not responsible for the correctness of any AI-generated attribution, dating, origin, authenticity claim or condition assessment, nor for the actual sale price, sell-through rate, conversion or revenue obtained from any listing produced with the Service.

The user remains solely responsible for verifying the accuracy, completeness and legality of every generated listing before publication, including but not limited to:

• The attribution and authenticity of the object;
• The estimated period, origin and provenance;
• The condition assessment and material identification;
• Any pricing or value statement;
• Compliance with the rules of the platform on which the listing is published.

Bidleys VOF accepts no liability for decisions made on the basis of AI-generated content, including loss of sale, incorrect attributions, takedowns by third-party platforms, or buyer disputes. Users are strongly advised to consult qualified experts when in doubt.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, or any specific commercial outcome — including any improvement in sell-through rate, click-through, conversion, ranking, visibility or final sale price on any third-party platform. Generation speed is provided as a typical estimate and may vary depending on load and the AI provider.

To the maximum extent permitted by law, Bidleys VOF is not liable for any loss or damage — direct, indirect, incidental, consequential, reputational or otherwise — arising out of or related to:

• incorrect, misleading, incomplete or infringing content in AI-generated output;
• removals, suspensions, sanctions or fee changes by third-party platforms (Catawiki, eBay, Etsy, Vinted, Marketplace, auction houses, etc.);
• buyer disputes, returns, chargebacks or claims of counterfeit or stolen goods relating to listings produced with the Service;
• third-party services we integrate with (payment processors, AI providers, cloud infrastructure, email providers);
• temporary unavailability, errors, security incidents or data loss of the platform.

Insofar as Bidleys VOF can nevertheless be held liable on any legal ground, our total aggregate liability towards a user is limited to the total subscription fees actually paid by that user in the six (6) months preceding the event giving rise to the claim, with an absolute maximum of EUR 500. This limitation does not apply in cases of intent or gross negligence on the part of Bidleys VOF's management, nor where mandatory consumer law prohibits such limitation.

The user indemnifies Bidleys VOF against any third-party claim that arises from or relates to the user's listings, conduct or breach of these Terms, and reimburses all reasonable legal costs incurred in defending against such claims.

We may suspend or terminate your account if you breach these Terms. You may cancel your account at any time. Upon termination, your data will be handled as described in our Privacy Policy.

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted exclusively to the competent court in Almelo, Nederland, except where mandatory consumer law grants the consumer the right to bring proceedings in their country of residence.
